1. Business Relationship
Nail Oasis LLC operates as an independent business and is not affiliated with, endorsed by, or responsible for the salon location in which it rents booth space. Services and products provided are solely the responsibility of Nail Oasis LLC.
2. Services and Products Provided
Nail Oasis LLC provides nail care services including gel manicures, hard gel services, gel pedicures, and nail art. Nail Oasis LLC also sells press-on nail products through its Square Online Store and Etsy shop. Services may be offered by appointment or on a walk-in basis, subject to availability.
3. Purchasing Through Third-Party Platforms
Nail Oasis LLC sells products through both its Square Online Store and its Etsy shop. When you purchase through Etsy, your transaction is subject to Etsy's terms of service and buyer protections in addition to these Terms. Nail Oasis LLC fulfills Etsy orders but does not control Etsy's platform policies, payment handling, or dispute resolution processes. For Etsy-specific concerns, you may contact Etsy directly through their buyer support channels.
4. Booking and Inquiries
Appointments must be booked through Square Appointments. Nail Oasis LLC also accepts inquiries through Instagram direct message, Facebook direct message, email, and text message. Inquiry through social media, email, or text does not constitute a confirmed booking. A booking is confirmed only when completed through Square Appointments, including card-on-file authorization.
5. Card on File Authorization
A valid credit or debit card is required to book all appointments. By entering your card through Square Appointments, you provide express written authorization for Nail Oasis LLC to charge that card for: completed services rendered, cancellation fees as described in the Cancellation and No-Show Policy section below, no-show fees as described in the Cancellation and No-Show Policy section below, and any other charges you have expressly approved at the time of booking.
This authorization remains valid for ongoing booking activity with Nail Oasis LLC. If your card on file has not been used for a period of 18 months or more, you may be asked to reauthorize before booking future appointments. Card-on-file storage and processing is handled through Square's payment infrastructure. Nail Oasis LLC does not store full card numbers independently.
6. Cancellation and No-Show Policy
Cancellations and Rescheduling: Please provide at least 24 hours notice to cancel or reschedule. Cancellations made with less than 24 hours notice will be charged 50% of the scheduled service total to the card on file.
No-Shows: A no-show is defined as a client who has not arrived and has not contacted Nail Oasis LLC within 15 minutes of the scheduled appointment start time. No-show clients will be charged 100% of the scheduled service total to the card on file.
Late Arrivals: Arrivals more than 15 minutes late may result in a shortened service or forfeited appointment at the technician's discretion. The full service fee may still apply.
Repeated Cancellations: Clients with two or more late cancellations or no-shows may be required to prepay in full before booking future appointments.
Client acknowledges that the cancellation and no-show fees described in this section represent a genuine pre-estimate of Nail Oasis LLC's lost appointment opportunity and associated overhead costs, and are not intended as a penalty.
By completing a booking through Square Appointments, you acknowledge and agree to this policy.
7. Appointments and Walk-Ins
Appointments are recommended but not required. Walk-in services are accepted when scheduling and availability permit. Nail Oasis LLC reserves the right to decline, reschedule, or terminate a service if doing so is necessary for safety, sanitation, or professionalism.
8. Payment Terms
Payment for services is due at the time services are provided unless otherwise stated. In-person and Square Online Store transactions are processed through Square. Etsy transactions are processed through Etsy's payment system. By providing a payment method through Square, you authorize Nail Oasis LLC to charge that method for amounts owed in accordance with these Terms.
9. Refund Policy
All service sales are final except as required by applicable law. Because services are personal and rendered immediately, refunds are generally not provided once a service has been completed. Service concerns including documented injury, allergic reaction, or defective application will be reviewed individually by Nail Oasis LLC upon documented inspection within 48 hours of the service.
For product orders placed through the Square Online Store, refunds are handled at Nail Oasis LLC's discretion. For product orders placed through Etsy, Etsy's buyer protection and return policies may also apply. If you experience a concern with a service or product, you must notify Nail Oasis LLC within 48 hours so the issue can be reviewed.
10. Dispute Resolution
Before pursuing any legal claim other than a small claims court filing, you agree to first provide Nail Oasis LLC with written notice of your concern within 48 hours of the service or incident in question. Nail Oasis LLC will have 5 business days to respond and attempt to resolve the issue informally. This notice requirement reflects a good faith expectation and does not affect any rights you may have under applicable law.
11. Health and Safety
Clients agree to disclose any allergies, skin conditions, infections, injuries, sensitivities, or medical concerns that could affect service safety prior to receiving services. Nail Oasis LLC may refuse or stop a service if it reasonably believes the service could cause harm or if sanitary standards cannot be maintained.
Gel and hard gel services involve chemical products and curing lamp exposure that may cause sensitization or allergic reaction in some individuals. By proceeding with gel services, you acknowledge awareness of this risk. Nail Oasis LLC recommends that clients with known chemical sensitivities discuss concerns before services begin.
12. Client Conduct
Clients must treat Nail Oasis LLC, its property, and any shared salon space with respect. Disruptive, abusive, unsafe, harassing, intoxicated, or unsanitary behavior may result in refusal of service or removal from the premises. Nail Oasis LLC does not refuse service on the basis of any protected characteristic under applicable federal or state law, including the Utah Antidiscrimination Act.
13. Communications
By booking an appointment or submitting an inquiry through any channel, you consent to receive communications from Nail Oasis LLC related to your appointment or order, including by text message, email, Instagram, Facebook, or phone. Consent to marketing or promotional communications is separate and not required to receive services. You may opt out of non-essential communications at any time by contacting us directly or replying STOP to SMS messages.
14. Age Requirements
In-person nail services are available to clients who are 18 years of age or older, or to clients under 18 with a parent or legal guardian present and providing consent. Nail Oasis LLC reserves the right to refuse service to any minor client at its discretion. Our online platforms are not intended for use by individuals under 13. See our Privacy Policy for additional information on children's data.
15. Photography and Endorsements
Nail Oasis LLC may photograph completed services for promotional use on social media with client consent. Clients are not required to consent to photography as a condition of receiving services. If a complimentary or discounted service is provided in exchange for a post, review, or testimonial, that material relationship will be disclosed in accordance with FTC guidelines.
16. Booth Renter Disclaimer
Nail Oasis LLC operates as an independent booth renter within a third-party salon. Nail Oasis LLC is not responsible for conditions within the host salon's common areas, parking facilities, or any areas outside its designated booth space.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NAIL OASIS LLC IS NOT RESPONSIBLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF ITS SERVICES OR PRODUCTS. FOR ANY DIRECT DAMAGES ARISING FROM A SPECIFIC SERVICE, NAIL OASIS LLC'S LIABILITY IS LIMITED TO THE AMOUNT PAID BY THE CLIENT FOR THAT SPECIFIC SERVICE. CLIENTS UNDERSTAND THAT BEAUTY SERVICES MAY INVOLVE RISKS INCLUDING SENSITIVITY, LIFTING, BREAKAGE, ALLERGIC REACTION, OR DISSATISFACTION WITH RESULTS. SOME STATES MAY NOT ALLOW LIMITATION OF LIABILITY FOR PERSONAL INJURY, IN WHICH CASE THIS LIMITATION APPLIES TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW. NAIL OASIS LLC IS NOT RESPONSIBLE FOR THE ACTS, OMISSIONS, OR POLICIES OF THIRD-PARTY PLATFORMS INCLUDING SQUARE AND ETSY.
18. Governing Law and Venue
These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any disputes arising under or related to these Terms shall be resolved in the state or federal courts located in Washington County, Utah. You consent to personal jurisdiction and venue in those courts.
19. Changes to Terms
Nail Oasis LLC may update these Terms at any time by posting a revised version or otherwise notifying clients. Continued use of services or products after changes are posted constitutes acceptance of the updated Terms.
